Terminological analysis of the legal support of lease operations


Nowadays leasing is an alternative to bank lending and an effective tool for updating fixed assets and applied technologies in Ukrainian enterprises. But there are some problems in development of this economical tool in Ukraine. The aim of the study is to deepen the content of the category "lease" and lease transactions in general by analyzing and systematizing the definitions contained in domestic and foreign regulations, international financial reporting standards (IFRS), as well as elimination of contradictions that negatively affect the investment climate in Ukraine. In the process of research such methods of cognition were used as: observation, comparison, induction and deduction, analysis and synthesis, historical and logical approaches, abstraction, generalization, methods of tabular presentation and comparison of information. The article substantiates the need for terminological analysis of the legal support of lease transactions, namely the consideration of the essence of lease transactions in domestic and foreign legislation, international standard. A comparative description of the nature of the category "lease" in accordance with IFRS 16 "Lease" and UAS 14 "Lease", and IPSAS 13 "Lease" and UAS PS 126 "Lease". The content of the category "leasing" is revealed and its differences from rent in Ukrainian legislation are established. It is proposed not to distinguish the essence of the concepts of "rent" and "leasing" in the legislative field and their legal regulation. This will bring the national regulatory framework closer to international standards and legislation of the world's most developed countries, as well as take another step towards deregulating and improving the investment climate in Ukraine. Prospects for further research are seen in addressing a number of pressing issues related to the accounting lease transactions in accordance with their essence and work to eliminate inconsistencies in Ukrainian legislation.
